Tokio Marine Insurance UAE Online Terms of Use & Telemarketing Consent

The website https://www.tmnf.ae/ (hereafter called the "Website") is administered by Tokio Marine & Nichido Fire Insurance Co Ltd, Agents for UAE: Al Futtaim Development Services Co Llc (hereafter called the "Company"). Please read the following terms and conditions carefully before accessing the Website and any information contained therein. By using the Website in any manner, you agree to all terms and conditions contained or referenced below. The content of the Website may change at any time without prior notification.

Part A: Online Terms and Conditions 

These terms apply when you use the online quotation and customer website of Tokio Marine & Nichido Fire Insurance Co., Ltd. (referred to as the Company, we or us). We call this the Website. Using the Website means you accept these terms. If any part of them does not sit well with you, please do not go on to use the Website. 

Who can use the Website 

You need to be at least 18 years old to request a quotation or to buy a policy through the Website. 

Getting your details right 

It is up to you to make sure that everything you tell us is true, complete and correct, and that you have not held anything back that matters. We work out any quotation or policy from what you tell us. If that turns out to be untrue, incomplete or misleading, we may turn down the proposal, treat any policy as if it never existed, or decline a claim made under it. 

Quotations and policies 

A quotation is indicative only and does not constitute acceptance of insurance. It remains subject to our underwriting, our acceptance and payment being made. A policy comes into being only once we have accepted it and the premium has been paid. Your cover starts on the date shown in the policy documents. 

Ownership of the content 

Everything you see on the Website belongs to us or is used by us under licence. You may not copy, reproduce or reuse it without our permission. 

Access to the Website 

We try to keep the Website running, but we cannot promise it will always be available. We may take it down, hold it back or limit any part of it at any time. 

Our responsibility 

So far as the law permits, we are not responsible for any loss that comes from using, or not being able to use, the Website, except where the law says otherwise or where it falls under the terms of a policy you hold with us. 

The law that applies 

These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai will deal with any dispute that arises out of them. 

Part B: Consent you give when using our forms 

This section sets out the required and optional consents that appear on our online forms, including the callback request, our quote journeys, and any other page where we ask for your details. 

The required declaration 

Before we act on any form you submit, you confirm the following, and this confirmation is required to proceed: 

I declare that the information I have provided is true, accurate and complete, and I understand that any policy issued may be declined or treated as void if it is found to be false. I confirm I am 18 years of age or over. I consent to Tokio Marine & Nichido Fire Insurance Co., Ltd. collecting, using and sharing my personal data as described in the Privacy Policy, including sharing it with service providers and partners and, where permitted by law, transferring it across borders. I have read and accept the Online Terms and Conditions. 

By ticking this box, you are giving your consent to the data processing described above. This action is required, and we do not treat silence or inaction as agreement to it. 

The optional marketing consent 

Separately, and only if you choose to tick it, you may also agree to receive marketing communications from us. This is entirely optional and you can proceed with your request whether or not you tick it: 

I agree to receive marketing from Tokio Marine & Nichido Fire Insurance Co., Ltd. about products, offers and renewals. This is not a condition of any purchase and I may withdraw at any time. 

By ticking this box, you are giving your consent to receive marketing. This action is optional, and we do not treat silence or inaction as agreement to it. 

Telemarketing Consent Terms and Conditions 

These terms describe the marketing communications you may receive from us once you have given the optional consent above. Please read them together with our Privacy Policy. We carry out telephone and electronic marketing in line with the laws of the United Arab Emirates that apply to us, including the telemarketing rules set by the Central Bank of the UAE for licensed financial institutions. 

What your consent allows 

When you give your consent, you are agreeing that we may reach you by telephone, by email or by SMS to tell you about our insurance products, our services, current offers and the renewal of your cover. Giving this consent is entirely your choice. You do not have to give it to receive a quotation, and it plays no part in whether you can buy any product or service from us. 

Your communication preferences 

When you give your consent, you can tell us your preferred language, the channels you would like us to use to reach you, including telephone, email, SMS or messaging application, the types of insurance products or services you would like to hear about, and, where this option is available to you, whether you would prefer to be contacted by one of our representatives or through automated communication methods. We will follow the preferences you set with us, and you may update them at any time. 

Confirming your age 

Before we rely on your consent, we will ask you to confirm that you are 18 years of age or over. 

Messages we may send without marketing consent 

If you hold a policy with us, we may still need to reach you about that policy. This includes renewal reminders, matters relating to a claim, payment information and other service messages that we are required or entitled to send. These are not marketing, and you will continue to receive them whether or not you have given marketing consent. If you ask us to call you back or otherwise get in touch, we may contact you in answer to that request. 

The way we will contact you 

Marketing calls will be placed only between 9:00 in the morning and 6:00 in the evening, UAE time, and within any narrower time you have asked us to keep to. We will not call you about the same matter more than once in a day, or more than twice in a week, unless you have asked us to follow up with you. Whenever we call, we will tell you who we are, explain why we are calling, and check that it is a good moment for you to talk. Calls may be recorded so that we can check quality, train our people, confirm what was agreed and meet our regulatory duties. 

Changing your mind 

You are free to withdraw your consent whenever you wish. Doing so costs you nothing, and it will not affect any policy you hold or any service message we are obliged to send you. To opt out, you can email us at callcenter@tmnf.ae, click the unsubscribe link in any marketing email, reply STOP to any marketing SMS, or simply tell whoever calls you. We will act on your request without delay. As soon as you opt out, we will stop sending you marketing and take you off our telemarketing list. 

The Do Not Call Register 

You may also register your number on the Do Not Call Register maintained by the Telecommunications and Digital Government Regulatory Authority. Subject to applicable laws and regulations, this helps prevent telemarketing calls from organisations required to comply with the Do Not Call Register requirements. It does not affect service related communications regarding your existing relationship with us. 

If something goes wrong 

If you are unhappy with any marketing contact from us, please raise it with us first, at callcenter@tmnf.ae, so we have the chance to look into it and put things right. If your complaint is not resolved within the timeframe the applicable regulations allow, you may then refer the matter to Sanadak, the independent Ombudsman Unit for the financial sector of the United Arab Emirates. 

Looking after your information 

We treat your personal information in the way set out in our Privacy Policy, which covers what we gather, how we use it, how long we hold it and the rights you have. 

Updates to these terms 

We may revise these terms from time to time. Whenever you give consent, we keep a note of the exact version that was in place at the moment you agreed.
