Tokio Marine Group Privacy Policy

The Tokio Marine Group is committed to the continuous enhancement of corporate value, with customer trust at the base of all its activities. Guided by this corporate philosophy, we, the Tokio Marine Group, shall comply with laws, rules, regulations and guidelines related to the protection of personal information, appropriately manage personal information as described below and implement other appropriate security measures for the protection of personal information of our customers.

This notice explains how Tokio Marine & Nichido Fire Insurance Co., Ltd. (referred to as the Company, we or us) gathers, uses, shares and safeguards your personal information, and what you are entitled to ask of us in return. We handle personal information in line with the laws of the United Arab Emirates that apply to us, including Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.

The information we gather

Depending on how you deal with us, we may hold:

  • ● Details that identify and reach you, such as your name, email address and mobile number.
    ● Identity documents and, where you are a business customer, business documents.
    ● Financial information.
    ● Whatever you share with us to get a quotation or take out a policy.
    ● Claim related information.
    ● Health information, where this applies to your policy or claim.
    ● Your contact preferences and a record of any consent you have given.
    ● Technical details such as your IP address and the device you use when you visit our website.
    ● A record of your dealings with us, including recordings of calls.
    ● Any other information or documents we are required to collect under applicable laws and regulations.

Why we use it

We use your information to:

  • ● Prepare quotations and issue and administer your policy.
    ● Assess underwriting and risk.
    ● Handle claims and look after you as a customer.
    ● Carry out anti-money laundering and counter-terrorist financing checks.
    ● Meet our regulatory reporting duties.
    ● Send you marketing, but only when you have agreed to receive it.
    ● Satisfy the wider legal and regulatory duties that apply to us.
    ● Keep proper records of the consent you give and our contact with you.

When we share it

We never sell your personal information. Depending on the product or service involved, we may share it with reinsurers, brokers, third party administrators, repairers, surveyors, loss adjusters, medical providers, banks, payment processors, legal advisers, auditors, actuaries, our regulators, law enforcement agencies, and other services providers and partners who help us provide our products and services or who we are required by law to share information with.

Your information may on occasion be transferred across borders in a manner permitted by applicable law, where an appropriate level of protection is available and, where required, after obtaining the necessary regulatory approvals. Anyone who handles your information on our behalf is bound to protect it and to use it only for the purposes we set them.

When we may use your information without asking your consent

UAE law allows us to use your personal information without your separate consent in a limited number of situations. These include, among others, where it is necessary to protect the public interest, where it concerns information you have already made public yourself, where it is needed to bring or defend a legal claim or in connection with judicial or security procedures, where it is necessary for occupational health assessments, medical diagnosis, or health and social care in line with UAE regulations, where it is necessary to protect public health, where it supports archiving or scientific, historical or statistical research, where it protects your own interests, where it is necessary to meet obligations connected with your employment or social security, where it is necessary to enter into, change or end a contract with you, or where another law in force in the State requires us to use it in this way.

Your consent to data processing

Where our use of your information is not already covered by one of the situations above, we ask for your consent before we collect, use or share it, including where this involves sharing it with our service providers and partners or transferring it across borders. On our forms, this is a separate, required consent, distinct from marketing consent. You confirm it by ticking a dedicated box, set apart from the general declaration and from any marketing consent. As with all consent, this is only valid where you take a clear, active step to give it, and we do not treat silence or inaction as agreement.

Marketing and your agreement

In addition to the data processing consent above, we only market to you when you have separately chosen to let us. This marketing consent is optional and is asked for on its own, in a clear and simple way, whether in writing or online, and we make sure you can withdraw it easily at any time. Consent is only valid where you take a clear, active step to give it, such as ticking a box. We do not treat silence or inaction as consent.

Each time you agree, we note when you agreed, how you did so and the exact wording you were shown, so that we can show your agreement was properly obtained. You can change your mind whenever you like, in the ways set out in our Telemarketing Consent Terms and Conditions. Withdrawing your consent does not affect the lawfulness of anything we did with your information before you withdrew it, and it does not stop the service messages tied to a policy you hold.

Keeping it safe

We put suitable technical and organisational safeguards in place to guard your information against loss, misuse and access by anyone who should not have it.

How long we keep it

We hold your information for as long as we need it for the purposes above, and for any longer stretch the law or our regulators require. Records of marketing calls and of the consent you give are kept for at least five years.

What you can ask of us

Subject to applicable law, you may ask us for access to the personal data we hold about you, information about how and why we process it, and details of the categories of recipients we have shared it with, including, where applicable, recipients outside the United Arab Emirates. You may also ask us to correct inaccurate or incomplete information, to restrict certain processing, to delete your personal data where this is legally possible, or to object to certain uses of your information. Where our processing relies on your consent, you may withdraw it at any time. You may ask about any automated decision making or profiling that affects you significantly, about our data retention practices, and about the safeguards we apply when your personal data is transferred across borders.
